Hi HelpIndex Licence Agreement ============================== This is a legal agreement between you and PHD Computer Consultants Ltd (PHD), United Kingdom. This text lists the "Evaluation", "Standard" and "Developer" licence terms. "Standard" and "Developer" are full licences. The features available in the different versions of Hi HelpIndex are listed on the Hi HelpIndex documentation Web site http://www.phdcc.com/helpindex/ You may purchase Hi HelpIndex licences either direct from PHD or through one of our outlets, as listed on the Hi HelpIndex Web site. The intellectual property, software, documentation and images for Hi HelpIndex, Hi Lab, Hi Jump, Hi Brow, Hi Help and MakeHelpIndex are Copyright (c) 1996-2005 PHD Computer Consultants Ltd. Downloading the evaluation version starts your 30 day evaluation period and implies that you accept this licence. The Evaluation licence lets you to try out the Hi HelpIndex evaluation version for 30 days for free. If you do not then purchase the appropriate full licence you must delete all copies of the software and documentation from your computers and Web sites. Purchasing a full licence ends your 30 day evaluation period. A Standard Licence permits you to use Hi HelpIndex on a single Web site. You may only use Hi Lab and the design-time bean components on one computer. You must pay for a Standard Hi HelpIndex licence for each of your Web sites, whether available to public or for internal use. In addition, you may keep a single working copy on one computer and a single copy on a backup medium. Purchasing a full licence entitles you to use Hi HelpIndex thereafter, but you are only entitled to upgrades and support for 12 months from the date of purchase. You may obtain upgrades from the Hi HelpIndex web site as directed in the documentation. PHD will not inform you of all upgrades. The Developer Licence permits you to use Hi HelpIndex on CD-ROMs and as the help system of your products. Only the unaltered Hi HelpIndex redistributable files may be included on the CD-ROM or in your product. The Hi HelpIndex development tools must not be included. PHD or its outlets supply the full Hi HelpIndex version in electronic form only, ie you do not receive a physical copy. You may not assign or resell your Hi HelpIndex licence or otherwise make Hi HelpIndex available to others without the consent of PHD. PHD will make a reasonable attempt to answer any relevant queries from users with a full licence for 12 months from the date of purchase. If your supplier handles support then please contact them first. You must place the Hi HelpIndex redistributable files on your Web site in their entirety, ie the archive file(s), all the class and image files and any others as directed in the documentation. You can have a full refund if you have a legitimate problem with the software within 30 days of purchase provided you confirm that you have destroyed all copies of the licence id. Any other refunds are at our discretion, must be made with 30 days and are subject to an administration fee, provided you confirm that you have destroyed all copies of the licence id. PHD does not agree to fix any apparent defects or limitations in the software. However if you notify PHD of the problem or have positive suggestions then PHD may change the software accordingly in the next release. You must not re-use, decompile or otherwise mis-use the Hi HelpIndex software. You may redistribute the current Hi HelpIndex evaluation version, provided it is distributed in its entirety. Please inform PHD so that we can keep the evaluation version up to date. Unless agreed otherwise, this agreement is governed by English law. NO WARRANTIES. To the maximum extent permitted by applicable law, PHD expressly disclaims any warranty for this software. This software and its documentation are provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability or fitness for a particular purpose. The entire risk arising out of use or performance of this software remains with you. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. To the maximum extent permitted by applicable law, in no event shall PHD or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, loss of business information, business interruption, or any other pecuniary loss) arising out of the use or inability to use this PHD product. If this licence is not acceptable to you or is not legally enforceable then PHD reserves the right to declare it void and return any fee paid. 1.6d January 2005
